BETTER CLARITY ON THE METHOD OF HARMONISATION OF SHARI’AH AND LAW WILL LEAD TO SMOOTHER IMPLEMENTATION OF HARMONISATION PROJECTS

Gombak, 10 September 2021. The Kulliyyah meets Prof Dato' Dr Mohammad Hashim Kamali, the Chief Executive Officer of the International Institute of Advanced Islamic Studies (IAIS) Malaysia for an early discussion on the harmonisation of Shari’ah and law. He was the first Chairman of the Harmonisation of Shari’ah and Law Unit at Ahmad Ibrahim Kulliyyah of Laws (AIKOL) in year 2002.
Prof Dato’ shares his thought on the essential and pressing issues relating to harmonisation including on the exposition of its relations with Maqasid Ash-Shari’ah. It is also pertinent to examine the practice in civil courts and Shari’ah courts since harmonisation could be done by the courts.
Prof Nik Ahmad Kamal Nik Mahmod raises the issue on the need to look back at the curriculum of the Kulliyyah with regard to harmonisation since the mission of the Kulliyyah is to work towards just laws and just legal systems through harmonisation of Shari’ah and law which is championed by balanced graduates. Since the Kulliyyah is approaching its 40 years anniversary, a review of the curriculum specifically on the issue of harmonisation is necessary.
Prof Azizah Mohamad shares the activities of the Harmonisation of Shari’ah and Law Unit such as Harmonisation Talk Series, the Round Table Discussion on Harmonisation of Shari’ah and Law and the chapters in book on harmonisation and other plans to intensify the discourse and the sharing of thoughts and efforts on harmonisation.
Prof Farid Sufian Shuaib emphasises that the curriculum should rise to the challenge of harmonisation. It is necessary to enhance the curriculum to ensure graduates have the tools for harmonisation of self and surrounding. The Kulliyyah will organise follow up meetings and programmes on specific issues of harmonisation.
